These Terms and Conditions govern your use of the Elite Burlingame Fence website located at burlingamefence.com and any services you engage us to provide. By accessing our website or entering into a service agreement with us, you agree to these terms. Please read them carefully.
By using this website or requesting services from Elite Burlingame Fence, you confirm that you are at least 18 years old and have the legal authority to enter into agreements. If you are requesting services on behalf of a property you do not own, you represent that you have the property owner's authorization to do so.
Elite Burlingame Fence provides residential and commercial fencing services in Burlingame, CA and surrounding communities. Services include but are not limited to fence installation, fence repair, fence replacement, gate installation, and fence staining and sealing.
All services are subject to site assessment, material availability, permit requirements, and project scope as agreed upon in a written estimate or contract. We reserve the right to decline any project that we determine is outside our scope, service area, or capabilities.
Written estimates are provided at no charge following an on-site assessment. An estimate represents the anticipated cost based on information available at the time of the site visit. Estimates are not binding contracts.
A formal project agreement or contract signed by both parties constitutes the binding price commitment. If site conditions, project scope, or material requirements change after the estimate is issued, we will notify you and provide a revised price before proceeding.
Estimates provided verbally, by phone, or by email without a follow-up written document are not binding. All pricing is subject to change if materials, permit fees, or labor costs change materially between the estimate date and project start date.
Where required by local ordinance, Elite Burlingame Fence will apply for and obtain the appropriate building permits before work begins. Permit fees will be itemized in your written estimate. Permit timelines are determined by the applicable city or county jurisdiction and are outside our control.
You are responsible for disclosing any homeowners association (HOA) rules, easements, deed restrictions, or other property-specific requirements before work begins. Work performed in compliance with information you provided in good faith will not be our responsibility if that information proves inaccurate.
Installation dates are confirmed in writing or by phone after a signed agreement and any required deposit are received. We will make reasonable efforts to accommodate your scheduling preferences.
If you need to reschedule, please notify us as early as possible. Cancellations made less than 48 hours before a scheduled installation may result in a rescheduling fee to cover crew scheduling costs. We reserve the right to reschedule due to weather conditions, permit delays, or other circumstances outside our control.
If you cancel a project after work has commenced, you are responsible for payment for all work completed and materials ordered or delivered at that point.
Payment terms are specified in your written project agreement. In most cases, we require a deposit before scheduling installation and final payment upon project completion. Accepted payment methods will be specified in your agreement.
Outstanding balances not paid within the timeframe specified in your agreement may be subject to a late fee. We reserve the right to place a mechanics lien on the property for unpaid work in accordance with California law.
We warrant that our workmanship will be free from defects in installation for a period of one year from the project completion date. This warranty covers defects in how the fence was built, not damage from normal wear and tear, weather events, impact, or improper care.
Manufacturer warranties on materials - such as vinyl fence panels or gate hardware - are passed through to you and are governed by the manufacturer's terms. We do not extend or modify manufacturer warranties.
This warranty is void if the fence or gate is modified, repaired, or altered by anyone other than Elite Burlingame Fence without our prior written consent.
Our liability to you for any claim arising from our services is limited to the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including but not limited to lost property value, lost use of your property, or costs resulting from permit delays.
We are not responsible for damage to underground utilities, irrigation lines, or other subsurface structures that were not properly marked or disclosed before excavation. You are responsible for calling 811 or providing accurate information about the location of underground systems on your property prior to our site visit.
You may use this website for lawful purposes only. You may not use it in any way that could damage, disable, or impair the site, or interfere with any other party's use of it. You may not attempt to gain unauthorized access to any part of the website or its underlying systems.
All content on this website - including text, images, and design - is owned by or licensed to Elite Burlingame Fence. You may not reproduce or republish website content without our written permission.
If a dispute arises from our services or these terms, we ask that you first contact us directly so we can attempt to resolve it informally. Most issues can be resolved quickly through a direct conversation.
If informal resolution is not possible, disputes will be resolved through binding arbitration in San Mateo County, California, in accordance with the rules of the American Arbitration Association. You waive your right to participate in a class action lawsuit or class-wide arbitration.
These Terms and Conditions are governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings not resolved through arbitration will be brought in the courts of San Mateo County, California.
We may update these Terms and Conditions at any time by posting a revised version on this page with an updated effective date. Continued use of our website or services after any update constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
